Guidance note extracted from practise note no. 2 issued by the Department
of Environment.![]()
"In relation
to the determination as to whether an eligible person is entitled to relief under
the regulations", it is stated that:-![]()
"authorities should consider whether, if the
room or extra feature were not available
(i) the disabled person would find
it physically impossible or extremely difficult to live in the dwelling, or
(ii) their health would suffer or the disability would be likely to become more
severe"
In the case of an extra room
if a carer is required by the disabled person, this when read in accordance with
other
government directives, clearly substantiates that local
authorities must grant this facility, benefit or tax banding. As without the extra
room there would be no carer and impossible difficulties placed upon the person,
with suffering to health.
